COURT AWARDS $1.8 MILLION+ TO PLAINTIFFS IN CLASS ACTION LAWSUIT AGAINST KIMKINS & HEIDI DIAZ (aka KIMMER) !!!

"Today, October 29, 2010, Judge Rick Brown of the Riverside County Superior Court entered a verdict for the plaintiffs in a certified national class action lawsuit. The court entered a verdict against Heidi Diaz the owner of the diet website Kimkins.com for fraud and false advertising. The court awarded the class members restitution in the amount of $1,824,210.39. The court also awarded an additional $500,000 in punitive damages as well as attorney fees. The court then issued a temporary restraining order to freeze all of the assets of Ms. Diaz.

Most notably, the court also imposed an injunction requiring Heidi Diaz to post on all of her websites that: (1) she lied about her weight loss; (2) she lied about her after diet pictures; (3) she lied about testimonials on her website; and (4) she lied about the photographs used with the testimonials to promote the Kimkins website.

An injunction was also issued to prevent Heidi Diaz from contracting, harassing or cyberbulling the plaintiffs and the witnesses. A formal judgment will be entered before November 19, 2010.

The original complaint was filed over three years ago on October 15, 2007. I want to thank everyone who supported the class action lawsuit. The Ducks* were wonderful. I met a lot of great people and made a lot of new friends fighting for a good cause. Heidi Diaz lied on her website and made the fatal mistake of lying in the courtroom. You cannot trust Heidi Diaz. I anticipate more legal (illegal) maneuvering by Heidi Diaz to evade the judgment. We will be prepared and I will be relentless. Again, I thank all you.

OFFICIAL NOTICE OF PENDENCY OF CLASS ACTION

TO: EVERYONE WHO PURCHASED A MEMBERSHIP TO KIMKINS.COM THROUGH THE KIMKINS.COM WEB SITE (www.kimkins.com) FROM JANUARY 1, 2006 TO OCTOBER 15, 2007

PLEASE READ THIS NOTICE CAREFULLY. YOUR RIGHTS MAY BE AFFECTED BY A CLASS-ACTION LAWSUIT THAT IS CURRENTLY PENDING IN RIVERSIDE COUNTY SUPERIOR COURT, IN RIVERSIDE, CALILFORNIA.

INTRODUCTION

1. On May 20, 2009, the Riverside County Superior Court, located in Riverside, California, issued an order certifying this case to proceed as a class action.

2. The plaintiffs are six individuals who bought memberships to kimkins.com through the kimkins.com Website (www.kimkins.com) from January 1, 2006 to October 15, 2007. The defendants are Heidi Diaz, an individual, and Kimkins (also known as Kimkins.com), a business entity that conducts business in Corona, California.

3. The plaintiffs contend that Diaz and Kimkins.com induced them into buying memberships for kimkins.com through false and misleading information provided on the Kimkins.com Web site. The plaintiffs contend that the defendants violated California Business & Professions Code § 17200, et seq., which authorizes courts to provide relief from unfair, unlawful, and fraudulent business practices. The plaintiffs also contend that Diaz and Kimkins.com violated common law prohibitions against fraud and negligent misrepresentation.

4. This notice provides you with information regarding the litigation, including the plaintiffs’ claims against the defendants and the current status of the litigation. This notice also provides you with information regarding the court’s class-certification order.

THE LITIGATION

The Plaintiffs’ Claims

5. This lawsuit is based on the plaintiffs’ claims that Diaz and Kimkins used unfair, unlawful, or fraudulent business practices to induce them into buying memberships to Kimkins.com. This lawsuit is also based on the plaintiffs’ claims that the false and misleading information contained on the kimkins.com Web site constituted fraud or negligent misrepresentation by Diaz and Kimkins.

6. Here’s a list of the kinds of misconduct that the plaintiffs have alleged:

• that Diaz and Kimkins concocted a false persona, “Kim Drake” or “Kimmer” to sell memberships to Kimkins.com

• that Diaz and Kimkins misled potential members into believing that “Kim Drake” was real by using photos of real women and then falsely claiming that the photos depicted “Drake”

• that Diaz and Kimkins posted lies about “Drake’s” purported weight loss

• that Diaz and Kimkins provided false or misleading information to Woman’s World magazine

• that Diaz and Kimkins made up celebrity endorsements

• that Diaz and Kimkins misused labels and metatags to steer Internet traffic to the Kimkins.com Website, in violation of the law

• that Diaz and Kimkins misled potential members into believing that they were buying lifetime memberships when, in fact, Diaz and Kimkins.com terminated memberships at their whim

• that Diaz and Kimkins intended to mislead potential members and assumed that potential members would rely on her misrepresentations.

The Defendants’ Position

7. Diaz and Kimkins have denied all allegations of wrongdoing and liability, and they continue to deny that they have done anything wrong. Diaz and Kimkins also have asserted various affirmative defenses to the plaintiffs’ claims.

THE COURT’S CLASS-CERTIFICATION ORDER

8. In an order filed May 20, 2009, the Court granted the Plaintiffs’ Motion for Class Certification. The Court certified for class treatment the plaintiffs’ claims for equitable relief, including disgorgement of the subscription fees paid to Diaz and Kimkins by the plaintiffs and the members of the class.

9. The certified class is defined as all individuals who purchased the Kimkins.com diet membership on-line from the Kimkins.com Web site from January 1, 2006 through October 15, 2007.

THE COURT HAS NOT EXPRESSED ANY OPINIONSREGARDING THE MERITS OF THE PLAINTIFFS’ CLAIMS

10. The Court ordered that this notice be provided to advise class members that this case is pending and that the Court has certified the case to proceed as a class action. You should not consider this notice or its mailing to be a statement by the Court that the plaintiffs are right or that their claims will prevail.

INSTRUCTIONS TO CLASS MEMBERS

11. You do not need to do anything to remain a member of the class. If you bought a Kimkins.com diet membership on-line from the Kimkins.com Website from January 1, 2006 through October 15, 2007—including either of those dates—you are automatically included in the class. Your rights will be represented by the plaintiffs and their attorneys. You will not be personally responsible for any attorney fees or for the any of the costs of this litigation.

OPT OUT OF CLASS ACTION LAWSUIT

12. You have the opportunity to opt out of the class action lawsuit as detailed herein. If you incurred a personal injury as a result of using the Kimkins.com aka Kimkins Diet, you have a right to opt out. THE LIGHTERLIFE DIET, STARVATION, AND ANOTHER DEATH...

It should really be called "The Loss-of-Life Diet."

Deaths are mounting, and terrible side effects of this starvation diet are being felt by many who follow it.

The Lighterlife diet is eerily reminiscent of the Kimkins starvation diet.

Any diet program which recommends its followers eat no more than 500 calories a day is not only scandalous but deadly. Many of those who followed Lighterlife and Kimkins now suffer from eating disorders, and other major health problems.

Like Lighterlife's founder, Jackie Cox, the Kimkins diet was developed by the morbidly obese Heidi Diaz, aka Kimmer.

And here are the women who tragically died while following the Lighterlife diet:

Samantha Clowe:

Samantha and her fiancé, Andrew

34-year-old Samantha Clowe collapsed at her home in Leeds, UK from heart failure in June of 2009 after following the LighterLife diet for 11 weeks.

Samantha weighed 17st 6 lb (244 lbs) when she started the diet, and had lost three stone (42 lbs) by following the strict plan, desperate to be slender in time for her wedding to fiancé, Andrew Smith.

"Jacqueline Henson, 40, was ‘over the moon’ when she shed 11 and a half pounds in the first week on the Lighter-Life diet, which involves drinking four litres of water a day..

‘Jacqui was told by the slimming consultant that the more water she drank the more weight she would lose.

'It wasn’t made clear to her that you had to spread the drinking through the day.’

A post mortem examination revealed Mrs Henson died from swelling of the brain caused by saturating the body with too much water. "


Matilda Callaghan:

Matilda Callaghan, 25, died in January 2006 after losing 10 stone (140 pounds) in six months on the Lighterlife diet.

A post-mortem found Matilda died from heart arrhythmia – when a heartbeat is not allowed sufficient time to ‘recover’ and the next beat interrupts.

For six months Matilda lived on only 500 calories a day, 1,500 less than the recommended daily amount, and was drinking between four and six litres of water daily.

So, so sad. All these deaths, and Lighterlife continues to thrive and Jackie Cox keeps raking in the money. Scandalous.

"Corona woman's diet program given low marks

A Corona woman's Internet-based weight-loss program has been named the worst diet product of 2008 by a healthy-eating Web site.

In announcing winners of its 20th annual Slim Chance Awards, the Healthy Weight Network -- an online forum for health care professionals, researchers and consumers -- said the Kimkins low-fat, low-carb diet amounts to a "starvation diet" that deprives members of many nutrients.

"This weight obsession is causing so many problems," said network founder Francie Berg, a licensed nutritionist and adjunct professor at the University of North Dakota School of Medicine.



Corona resident Heidi Diaz, founder of the Kimkins program, which charges members a fee to access the diet, could not be reached Tuesday by phone or e-mail.

A pending class-action lawsuit filed against Diaz claims that Diaz misled consumers with made-up success stories and pilfered images from a Russian dating Web site to depict as successful Kimkins dieters.

Some Kimkins members have said that they suffered hair loss, heart palpitations, weakness, nausea, muscle fatigue, forgetfulness and abnormal menstrual cycles.

Court records show that Diaz dropped her lawyer this month and is representing herself.



In an online message to Kimkins members posted a year ago, Diaz acknowledged that she had not lost 198 pounds in 11 months, as she had claimed on her site, but 100 pounds in six months. She also wrote that photos accompanying success stories were taken from another site.

"We wanted to show visitors the possibilities with Kimkins," she said.

Woman's World magazine featured the Kimkins diet program on its cover in June 2007 with the headline "Better than gastric bypass!" The magazine later apologized to readers for "having shared with you a story we can't stand behind."



As of Tuesday, the Kimkins Web site was still running, telling visitors that "many Kimkins members drop 5 percent or more of their total body weight in the first 10 days."

Members pay $79.90 to join the program.

A disclaimer tells visitors to contact their doctor before starting any diet.

Berg said people should focus less on losing weight and concentrate more on eating well, staying active and relieving stress.

Berg's Web site named as its worst gimmick of 2008 a brand of jeans that claims to release a cellulite-fighting medication when the jeans rub against the skin.

"Some of this is just ridiculous," Berg said.

And this is what was said about the Kimkins diet by The Healthy Weight Network in awarding Kimkins the 2008 Slim Chance Award:

"WORST PRODUCT: Kimkins diet. It must have seemed an easy way to get rich quick. Founder Heidi “Kimmer” Diaz set up a website and charged members a fee to access the Kimkins diet, boasting they could lose up to 5 percent of their body weight in 10 days. “Better than gastric bypass,” there was “no faster diet,” and in fact she herself had lost 198# in 11 months. Stunning “after” photos were displayed. In June 2007 Women's World ran it as a cover story, and that month alone PayPal records show the Kimkins site took in over $1.2 million. Then users began complaining of chest pains, hair loss, heart palpitations, irritability and menstrual irregularities. This was not surprising since Kimkins is essentially a starvation diet, down to 500 calories per day and deficient in many nutrients (appallingly, laxatives are advised to replace the missing fiber). In a lawsuit, 11 former members are uncovering a vast record of Diez’s alleged fraud. They found that the stunning “after” photos, including one of Kimmer herself, had been lifted from a Russian mail order bride site. According to a deposition reported by Los Angeles TV station KTLA, Diaz admitted using fake pictures, fake stories and fake IDs, and a judge has allowed the litigants to freeze some of her assets."

Way to go, Heidi! Nothing like making headlines in your own backyard. Didn't you say any publicity is good publicity? Want to take that back?

And for those who may not be aware, Heidi Diaz DID NOT lose 100 pounds in 6 months as she claimed in her "confession" on her website. Heidi Diaz (aka Kimmer) never lost one pound and remains morbidly obese, as can be seen in the above photographs.

HEIDI DIAZ FILES CROSS-COMPLAINT IN CIVIL ACTION: NOW ISN'T THAT RICH?

In what is perhaps the greatest show of brass cajones in recent memory, Heidi Diaz aka Kimmer, creator of the Kimkins starvation diet, has filed a Cross-Complaint for Damages for the following:

1. Interference with Contract
2. Interference with Economic Advantage
3. Slander/Libel
4. Invasion of Privacy
5. Civil Conspiracy; and last but not least...
6. Intentional Infliction of Emotional Distress.

Oh, this is rich. Intentional Infliction of Emotional Distress? Seriously, Heidi, you've got to be kidding.

Heidi, I'll tell you what's "despicable, outrageous, intentional and malicious and done with reckless disregard of the fact that such acts would certainly cause...severe emotional and physical distress": YOUR PERPETUATION OF THE DEADLY KIMKINS STARVATION DIET ON WOMEN DESPERATE TO LOSE WEIGHT.

Paragraphs 64, 65 and 66 in your Cross-Complaint are so laughable they're not worthy of comment.

You want to talk about physical illness and emotional distress? Talk to some of the ex-Kimkins members whose lives have been deleteriously and irretrievably changed as a result of following your deadly diet.

Your spurious Cross-Complaint is without merit and reeks of a desperate attempt to intimidate. Trust me on this...it's had the opposite effect. The forces are galvanizing.

THE DEADLY KIMKINS DIET: STARVATION IS NOT PRETTY...

This poor woman looks like death warmed over. "Jan" is the latest Kimkins diet "success story." Jan is on her way to an early death.




Note she has lost most of her hair, her skin is sallow, and her face is becoming skeletal.

It's beyond comprehension that people continue to follow the Kimkins starvation diet, ignoring all the evidence that the diet's founder, Heidi Diaz aka Kimmer, is a morbidly-obese admitted fraud and liar, who is being sued in civil court by former Kimkins members. And word is Federal charges are pending against her.

ROBERT CHARLTON, THE PI WHO CAPTURED HEIDI DIAZ ON FILM, IS HERE TO ANSWER YOUR QUESTIONS!

For those who were following the story of the deadly Kimkins diet and its founder Heidi Diaz aka Kimmer back in the fall of 2007, the day that the pictures and video of Heidi Diaz were released caused our jaws to collectively hit the floor.

Heidi, as captured on film by Robert Charlton, Private Investigator and owner of Alliance Investigative Services, was not the svelte woman she had led people to believe but a morbidly obese woman weighing over 300 pounds. Finally, there was the physical proof that Heidi Diaz/Kimmer was, indeed, a liar and a fraud.

Robert's photos and video were subsequently used by not only Chip Yost of KTLA but by The Morning Show with Mike and Juliet.

Although Robert was given credit by KTLA for a few seconds the first time their program aired, he was not given credit by KTLA in their follow-ups. And no credit was given to Robert by The Morning Show for their usage of his photos or video. So I would like to take this opportunity to publicly thank Robert for all his efforts in capturing Heidi Diaz on film.

URGENT WARNING !!! PREGNANT ??? DO *NOT* DO THE KIMKINS STARVATION DIET !!!

The Kimkins diet, created by Heidi Diaz, aka Kimmer, is a deadly starvation diet. If you are unfamiliar with the Kimkins diet, do a quick Google search and you will find hundreds of websites warning of the dangers of the diet and the fraudulent actions of Heidi Diaz aka Kimmer.

On the Kimkins website, several female members have asked if anyone has done the Kimkins diet while pregnant. One member said that she didn't want to gain weight and would "actually like to lose a little weight" while pregnant.

Rather than stepping up to the plate and telling these women that following the nutritionally bankrupt Kimkins starvation diet could result in causing untold harm to the fetus, Heidi Diaz aka Kimmer and her sidekick, SingingLass, and whatever administrators are left in that Kimkins ghost town, have failed to warn these women that dieting is the last thing they should do while pregnant.

FASCINATION FADING WITH THE DRAMA QUEENS

I'd better get this post up before the reappearance of the two Drama Queens on the Fascination thread at Low Carb Friends.

First of all, we have AmyB, who seems hell bent on posting every personal thought she's ever had and the minutiae of her life second by second, revealing everything except her Aunt Gertrude's dog's name on the thread. AmyB, listen, honey. Send PMs. And you've got a blog. Post there. Please.

And next we have TwiddleDee who comes crashing and burning from Kimkins into the Fascination thread, alienating most within the first 30 seconds with her not-so-passive-aggressive posts. Within 48 hours, she has an epiphany and suddenly renounces Heidi Diaz/Kimmer. Then, after being asked a few very valid questions, which she refused to deem worthy of a response, she stomps off the thread in a huff, leaving a terse message that she'd be better off dead. Nice work, Dee/DEEDLYNN/whatever.

You know, many Kimkins members have joined LCF and posted in the Fascination thread but none that I can remember have alienated as many people as quickly as Dee.

Dee's behaviour has done nothing to endear her to even her former supporters on FWK and has left many questioning not only her motives but her denunciation of Kimmer. Is it all an act? Is she a Kimmer plant? Who knows. And who really cares at this point. Most of us are Dee'd out.

Carly and Malucas, both having been banned from Kimkins, have posted on LCF and have been welcomed. Perhaps they both could give some tips to Dee on how to win friends and influence people...not that I'm in any way encouraging them to do so.

And a personal note to Malucas:

Malucas, I'm truly sorry that my post on shiphips caused your banning at Kimkins. Heidi, if you're reading this, shiphips was dead wrong. Malucas was not a mole. Not that you really care, Heidi...I just wanted to set the record straight. Malucas, I'm relieved you got out of the Kimpound, and wish you all the best.

What causes histrionic personality disorder?

For example, the tendency for histrionic personality disorder to run in families suggests that a genetic susceptibility for the disorder might be inherited. However, the child of a parent with this disorder might simply be repeating learned behavior.

Other environmental factors that might be involved include a lack of criticism or punishment as a child, positive reinforcement that is given only when a child completes certain approved behaviors, and unpredictable attention given to a child by his or her parent(s), all leading to confusion about what types of behavior earn parental approval.

How is histrionic personality disorder diagnosed?

If symptoms are present, the doctor will begin an evaluation by performing a complete medical history and physical examination. HEIDI DIAZ & HER LIES CONTINUE: SETTING THE RECORD STRAIGHT

This morning on the Fascination thread on Low Carb Friends, Dee posted a Private Message that Heidi Diaz/Kimmer sent to her. In the PM was this comment by Heidi:

"...Medusa is always emailing KK members (especially the 100 pound losers)."

Just to set the record straight, that is an outright lie. The only current members of Kimkins I have ever e-mailed are Dee and Patti, and that was this past week to ask for their assistance regarding the 17-year-old Kimkins.con member who is suffering from an eating disorder.

For those who believed that the 17-year-old girl is a Kimkins sock puppet, I received written evidence today which proves, without a shadow of a doubt, that she is, in fact, real and NOT a sock puppet.

Yesterday (May 14/08), I received information from a member of Kimkins about a 17-year-old girl who, in her first post, admitted she had an eating disorder.

In an effort to reach out to this young girl, I attempted to enlist the assistance of Kimkins members, Dee/DEEDLYNN/DEEDLYNN22, who has recently been posting on Low Carb Friends, and Patti, one of the current KK cover girls, to intervene.

Below is a copy of my e-mail to Patti:

I suppose it depends on how you look at it. I'm 17 years old, I am a Jr. at
Pepperdine University and I go there on a scholarship, I'm pre-medicine, I
love to read and write... and I have this tricky little thing called an eating disorder.

It's bothered me for a long, long time. I have screamed at God, I have screamed at my parents, I have screamed at myself. I have cut myself. I have contemplated suicide.

One day, I asked myself why it is better to commit suicide than to change my life. Even if changing my life was the most difficult thing imaginable, I do believe that I would be happier once I'd done it - so clearly, taking a difficult step towards happiness is far wiser than taking a selfish step towards oblivion. For me, this seems so unlikely that I don't think I'll ever get married - and here is why. When you read a great piece of literature, you fall in love with a multi-faceted thing which is greater than you are. Words on a page, in my opinion, truly can overcome reality. And so it is that I love this - this depth, this power, this beauty which not even the author could fully grasp - so much that I don't believe it is possible to love something which is tangible quite as much. The only way I can see of falling in love with someone is if he joined me in that same love. But I have not met anyone who is like that yet. I've definitely got some issues. I'm 17 years old and I'm a Jr. at Pepperdine University. When I was 12 I had anorexia and since then I have developed a pretty clean case of Binge Eating Disorder. (it does exist... it's not just made up). So, I\'m here to change that and change myself. I'll be honest - there is a boy I like and I think he could like me too. But we're off school for the summer and I want to become a different person.

However, I want this blog to be about more than that - I love philosophy, literature, science - really anything that makes you think. My favorite books would be The Catcher in the Rye, Atlas Shrugged or The Plague. My favorite movies - Scanner Darkly or Shawshank Re "

Late yesterday, the 17-year-old girl posted this on Kimkins:

Having not heard back from Dee/DEEDLYNN/DEEDLYNN22, I sent her another e-mail this morning:

Shame on you Heidi, Dee, and Patti. Your lack of concern for this young girl is despicable.

No rules changed. I simply reminded everyone to try to stay on topic for the benefit of everyone that would like to read the thread. That doesn't mean to only post "results". I understand that friendships are made and there will naturally be some posts unrelated to the topic, but I just ask you to consider whether some of the comments could be posted in other more appropriate forums or threads or in a PM.

It actually doesn't matter much to me since I don't read all the posts in these threads, but some people that would like to are simply unable to keep up because of the large volume of off-topic posts and have expressed some frustration.
